1. Fair Use Policy
   It is important to ToggleText that all web site users are able to access its facilities. Accordingly, we have a Fair Use Policy which applies to use of this web site, including the free Kataku translation service.

   Excessive Use:
   

   1. In the case of the free Kataku translation service performing directly, or on behalf of others, more than 100 translations per day is excessive use.

   Unreasonable Use:
   

   1. It is unreasonable use of the ToggleText web site where your use of the ToggleText web site is reasonably considered by ToggleText to be fraudulent or to adversely affect the web site or other ToggleText web site users' use of or access to the ToggleText web site.
   2. Among other things, "fraudulent use" includes selling or reselling the free Kataku translation service without ToggleText's consent.

   Our rights:
   

   1. Where you are in breach of this Fair Use Policy, ToggleText may contact you to discuss changing your usage so that it conforms to this Fair Use Policy.
   2. If, after ToggleText has contacted you, your excessive or unreasonable use continues, ToggleText may, without further notice to you suspend or limit your use of the website for any period we think is reasonably necessary.
   3. Where you are in breach of this Fair Use Policy and ToggleText is not able to contact you with reasonable effort, ToggleText may, without further notice to you suspend or limit your use of the website for any period we think is reasonably necessary.
2. ToggleText holds no responsibility for translation inaccuracies
   The inherent ambiguities of language means there are a number of different translations and interpretations for particular words and phrases, which lead to limitations in the accuracy of automatic translations. ToggleText therefore recommends that you examine the translation resulting from use of our services. We accept no responsibility for the accuracy thereof.
3. ToggleText holds no responsibility for the users' application of translations
   You are completely responsible for the content of the documents and the implications of translations and the manner in which they are used. Any use of the automatic translator is at your own risk.
4. ToggleText holds no responsibility for defects or loss of text
   Although ToggleText employs all reasonable efforts in providing our services, ToggleText accepts no responsibility for the results of any errors, defects and/or risks associated with the use of its translator, including:
   
   
   1. documents or text lost or damaged in transmission over the Internet
   2. a breach of confidentiality when a document is transmitted over the Internet.
5. Usage conditions
   ToggleText's Automatic Translation Service is provided on the condition that:
   
   
   1. You use our services only for lawful purposes. The translator is not to be used to translate any of the following: obscene, defamatory, unlawful material or information, and/or confidential or proprietary information, including trademarks or copyrighted information, belonging to a third party, without the explicit authorisation of the relevant rights holder.
      
   2. You agree to indemnify ToggleText for all claims relating to your use of our services, and/or the reproduction or transmission of the material translated.
6. Limitation of liability
   In no circumstances will ToggleText be liable for any indirect, specific, incidental, economic or consequential damages arising out of the use of the translator, including damages for loss of profits, business, goodwill, data, any interruption or delay in business, or other financial loss.
7. Your privacy
   ToggleText recognises your right to privacy. Any information given to us is kept confidential. Translations may be stored for internal assessment procedures but will not be used for any other purpose without your consent.
8. Changes to the Terms and Conditions
   ToggleText reserves the right to vary these Terms and Conditions from time to time.
